Terms of Service.

These terms are an agreement between you and Sugi Studio Pty Ltd ("Sugi Studio", "we", "us" or "our"), a company registered in Australia. They cover your use of the nomi mobile app, this website and any related services (together, "nomi").
By downloading, opening or using nomi, you agree to these terms. If you don't agree, please don't use nomi. Our Privacy Policy explains how we handle your personal information.
The short version
- nomi plans dinners and builds grocery lists. Costs and nutrition figures are estimates.
- Planning needs a subscription, billed by Apple or Google. It renews until you cancel it in your store settings. Deleting the app or your account does not cancel it.
- If you have a food allergy, always check ingredient labels. nomi is not medical advice.
- Use nomi for your own household. Don't copy, scrape or resell our recipes or content.
- If you're in Australia, the Australian Consumer Law gives you rights that these terms can't take away. The same goes for consumer laws where you live.
1. Who can use nomi
nomi is made for adults. You must be at least 18 years old, or the age of majority where you live if that's older, to use nomi or buy a subscription.
2. Your account
nomi creates an account for you automatically the first time you open the app, so you can start planning without signing up. That account is tied to the app on your device.
- Where it's available, you can link Sign in with Apple or Google to your account so you can sign back in on a new phone. If you don't, you lose access to the account when you delete the app or change devices.
- Please give accurate information and keep your device and sign-in method secure.
- You're responsible for what happens under your account. If you think someone else has used it, tell us at support@sugistudio.dev.
3. Subscriptions, free trials and offer codes
Buying a subscription
Planning your week with nomi needs an active subscription. We offer monthly and yearly plans. The app shows the price, billing period and any trial before you buy, in your local currency.
Subscriptions are sold through the Apple App Store or Google Play (the "store"). The store takes payment and charges your store account when you confirm the purchase, or when your free trial ends. The store's own terms also apply to your purchase.
Automatic renewal
Your subscription renews automatically at the end of each billing period, for the same period and at the then-current price, until you cancel. To avoid being charged for the next period, cancel at least 24 hours before the current one ends. The store may charge the renewal within the 24 hours before the period ends.
Free trials
New subscribers may be offered a free trial (currently 7 days). If you don't cancel at least 24 hours before the trial ends, your paid subscription starts and the store charges you for the first period. Trials are for new subscribers only, and the store decides who is eligible.
Cancelling
- iPhone: Settings → your name → Subscriptions → nomi.
- Android: Google Play → your profile → Payments & subscriptions → Subscriptions → nomi.
Cancelling stops the next renewal. You keep access until the end of the period you've paid for. Deleting the app or your nomi account does not cancel your subscription.
Refunds
Because the store handles payment, refund requests go to Apple or Google under their refund policies. We can't refund store purchases ourselves. This doesn't limit your rights under the Australian Consumer Law or other consumer laws (see section 11).
Price changes
We may change subscription prices. The store will tell you before a new price applies, as its rules require, and may ask you to agree to it. A new price applies from your next renewal, and you can cancel before then.
Offer and promo codes
We may give out codes for free or discounted access. Each code has the terms shown with it, such as how long it lasts and when it expires. Codes have no cash value and can't be sold or transferred. We may cancel codes that were obtained or used unfairly, for example by creating many accounts.
4. Estimates, recipes and food safety
- Costs are estimates. Weekly costs and ingredient prices are based on typical prices and will vary by store, region, season and promotions. We don't guarantee what any product costs or that it's in stock.
- Nutrition is approximate. Calories and macros are calculated from typical ingredient data and will vary with the brands you buy and how you portion.
- Allergies and diets. Diet and allergy filters rely on ingredient information that may be incomplete or wrong, and packaged products can contain allergens or traces of them. Always read ingredient labels. If you have a serious allergy, don't rely on nomi alone.
- Not medical advice. nomi is not a medical device and gives general information only. It doesn't diagnose, treat, cure or prevent any condition. If you have medical dietary needs, are pregnant, or have a history of disordered eating, check with a healthcare professional.
- Cooking safely is on you. Store and handle food safely, cook it to safe temperatures, take care with knives, heat and appliances, and supervise children in the kitchen.
5. Supermarkets and other third parties
nomi lets you choose where you shop. Supermarket names and logos belong to their owners and are shown only to identify the store you pick. nomi isn't affiliated with, sponsored by or endorsed by any supermarket.
nomi relies on third-party services such as the app stores and Sign in with Apple or Google, and may link to other websites. Their terms apply to your use of them, and we're not responsible for their content or services.
6. Acceptable use
When you use nomi, please don't:
- copy, scrape or extract our recipes, photos, prices or other content, by hand at scale or with automated tools;
- sell, sublicense or redistribute nomi or its content, or use it to build a competing product;
- reverse engineer or decompile the app, except where the law allows it;
- get around the subscription, trial limits or security, or interfere with or overload our systems;
- create accounts in bulk or abuse free trials or offer codes;
- use nomi for anything unlawful, harmful or fraudulent.
7. Your content
You keep ownership of what you add to nomi, such as your name, grocery items, ratings and messages to us. You give us a worldwide, non-exclusive, royalty-free licence to store, copy and process that content only as needed to run nomi for you. The licence ends when your content is deleted.
If you send us ideas or feedback, we may use them to improve nomi without owing you anything. Thank you, we read every one.
8. Our content and your licence
nomi, including its software, recipes, photos, illustrations, text, and the nomi name and logo, belongs to us or our licensors and is protected by intellectual property laws.
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the nomi app on devices you own or control, for your own household's non-commercial use, under these terms and the store's usage rules. We keep all rights we don't expressly give you.
9. Changes to nomi
We're always improving nomi, so we may add, change or remove features, recipes, supported countries and stores. If a change will substantially reduce what a paid subscription gives you, we'll tell you in advance where we reasonably can, and you can cancel.
We aim to keep nomi running smoothly, but it may sometimes be unavailable for maintenance or reasons outside our control. If we ever decide to shut nomi down, we'll give you reasonable notice.
10. Deleting your account and ending these terms
You can stop using nomi at any time. You can delete your account in the app (Settings → Account → Delete my account) or by following the steps on our account deletion page. Remember to cancel your subscription in your store settings too.
We may suspend or close your account if you seriously or repeatedly breach these terms, if the law requires it, or to protect nomi or other people. Where we can, we'll tell you why and give you a chance to fix the problem first.
Sections 4, 7, 8, 11, 12, 15 and 16 continue to apply after these terms end.
11. Your consumer rights
If you're a consumer in Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
If you live somewhere else, you may have rights under your local consumer laws. Nothing in these terms limits rights that can't be limited by law.
12. Disclaimers and liability
Apart from the rights described in section 11 and anything else the law doesn't let us exclude, nomi is provided "as is" and "as available", and we give no other promises about it, including that it will be error-free or that its estimates will be accurate.
To the extent the law allows:
- we're not liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill, arising from your use of nomi;
- our total liability to you for all claims relating to nomi is limited to the amount you paid for nomi in the 12 months before the claim arose;
- where the Australian Consumer Law lets us limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law. If you're in the European Union or the United Kingdom, we're responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
13. Extra terms for Apple devices
If you got nomi from the Apple App Store, these terms also apply:
- These terms are between you and Sugi Studio, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded products you own or control, as the App Store's Usage Rules allow, including through Family Sharing.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you can tell Apple, and Apple will refund the purchase price (if any) for the app. To the extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If anyone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you're not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you're not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce them against you.
14. Changes to these terms
We may update these terms as nomi changes or the law requires. We'll change the "last updated" date above, and for significant changes we'll tell you in the app or by other reasonable means before they take effect. If you keep using nomi after a change takes effect, the new terms apply. If you don't agree with them, stop using nomi and cancel your subscription.
15. Governing law and disputes
If something goes wrong, please contact us first at support@sugistudio.dev and we'll try to sort it out informally.
These terms are governed by the laws of Victoria, Australia. The courts of Victoria, and courts that can hear appeals from them, have non-exclusive jurisdiction. If you're a consumer living in another country, you can also bring a claim in the courts where you live, and you keep the protection of that country's mandatory consumer laws.
16. General
- These terms, our Privacy Policy and any terms shown with an offer make up the whole agreement between you and us about nomi.
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right straight away, we haven't given it up.
- We may transfer our rights and obligations under these terms to another business, for example if nomi is sold, as long as your rights aren't reduced. You may not transfer yours.
- Apart from Apple as described in section 13, nobody else has rights under these terms.
